The $400 cap applied only to the first-ever Inflation Refund checks mailed in fall 2025.

Basic requirements: To get the inflation check, you must have:

  • Filed a NY Form IT-201 (full-year resident return).
  • Been a full-year NY resident
  • Had NY Adjusted Gross Income within the income limits below
  • Not claimed as a dependent on someone else’s return.

Part-year or nonresident filers (IT-203) are not eligible.

IMPORTANT
There is no citizenship requirement beyond filing a New York return. Any full-year resident, citizen or not, who legally files Form IT-201 is generally treated the same.

New York law taxes resident aliens like citizens, so filers with ITINs who meet all other eligibility requirements should generally qualify.

  • Apply for replacement: If a check went uncashed, you should receive Forms DTF-32/DTF-36 (Uncashed Check Notice and Application) from the Tax Dept.
  • Check the Unclaimed Funds: If the refund was never claimed, the Comptroller’s Office of Unclaimed Funds might hold it after a year.
