Does California Have an Inheritance Tax?

No, California does not currently impose a state inheritance tax on people who receive money or property from someone who has died.

So, you do not owe California tax simply because your parent leaves you $100,000, your spouse leaves you investments, or a relative names you as the beneficiary of a taxable estate.

California also does not currently impose a gift tax on ordinary lifetime gifts.

Inheritance Tax vs. Estate Tax

An inheritance tax is imposed on the person receiving an inheritance. An estate tax is imposed on the deceased person’s estate before the remaining assets are distributed.

California currently imposes neither tax on ordinary inheritances. The federal government, however, still has an estate tax for qualifying large estates.

At a glance Inheritance tax Estate tax
What is it? Tax on what you inherit Tax on the deceased person’s estate
Who pays? The person inheriting The estate
California tax? None None
Federal tax? No federal inheritance tax Yes, for certain large estates
Latest federal limit Not applicable $15 million per person
Tax rate Not applicable Up to 40%
Do most families pay? No No; most estates are below the federal limit

Only a small number of states impose inheritance taxes. Some exempt spouses and close relatives, while others apply different rates depending on the beneficiary’s relationship to the deceased.

Suppose your mother leaves you $300,000 in cash and investments. If California law governs the inheritance, you generally do not owe California inheritance tax on the $300,000 itself. If the estate is also below the applicable federal estate-tax threshold and no other state’s death tax applies, the inheritance may pass without estate or inheritance tax.

Do You Pay Income Tax on Inherited Money or Property?

No, inherited money and property are not treated as ordinary income simply because you receive them.

For example, if you inherit $100,000 in cash, you are not required to report that $100,000 as income on your federal or California income tax return. The same applies to inheriting stocks or other property.

But income earned after the inheritance may be taxable.

Consider these examples:

  • Inherited cash: You inherit $100,000 and earn $3,000 in bank interest. The interest may be taxable, but the inherited $100,000 is not.
  • Inherited rental property: You receive a house and rent it to tenants. The rental income may be taxable, subject to applicable deductions and other rules.
  • Inherited stocks: You receive shares that pay dividends. Then, the dividends may be taxable.
  • Inherited property that you sell: You may owe capital gains tax if the property increases in value after the applicable tax basis is established.

What Happens When You Sell an Inherited House?

When you sell an inherited house in California, it may trigger capital gains tax, but you pay tax only on the profit above its fair market value when the previous owner died, minus eligible selling costs.

Calculation Demo Amount
Home value when parent died $600,000
Selling price $650,000
Realtor fees and eligible selling costs −$30,000
Estimated taxable capital gain $20,000
California inheritance tax $0
Capital gains tax Generally applies to the $20,000 gain, not the full $650,000 sale price.

Inherited Retirement Accounts

Inherited traditional IRAs, 401(k)s, pensions, and certain annuities may generate taxable income when distributions are taken.

Just because you are receiving an inherited traditional IRA does not necessarily mean the entire account is taxable on the day you inherit it.

But the distributions from that account are generally subject to income-tax rules, and required distribution deadlines may apply.

Account type Is the money taxable when withdrawn?
Traditional IRA Usually taxable
Traditional 401(k) Usually taxable
Roth IRA Usually tax-free if requirements are met
Roth 401(k) Usually tax-free if requirements are met
Pension or annuity Depends on the plan

Does the Estate Have to File a Tax Return?

An estate or trust may earn interest, dividends, rental income, or other income while its assets are being administered.

A California estate may need to file Form 541, the California Fiduciary Income Tax Return.

The estate’s executor or administrator generally handles the applicable filing responsibilities.

And depending on the estate’s income and distributions, beneficiaries may receive Schedule K-1 forms showing income they must report on their own returns.

Inheriting from Another State

California does not impose an inheritance tax simply because a California resident receives an inheritance from another state.

But the other state may impose an estate tax or inheritance tax under its own rules.

1. If You Live in California and Inherit Property Elsewhere

Suppose you live in California and inherit a house in Pennsylvania from a relative who lived there.

California generally does not tax the inherited value as income. But Pennsylvania may impose an inheritance tax on the transfer, depending on the beneficiary’s relationship to the deceased and the property’s treatment under state law.

2. If Someone From Another State Leaves You California Property

Now suppose a Nevada resident dies and leaves you a house in Sacramento.

California generally does not impose inheritance tax on the transfer. But the property may need a California legal proceeding or other documentation to transfer ownership, depending on how it was held and the applicable probate rules.

The property is also subject to California’s property-tax rules, including reassessment rules and any available exclusions.
